City's Right to Pump Water from Big Chino Upheld
Friday, October 30, 2009
The following summary was prepared by Regional Program Director, Craig McConnell regarding the hearing officer's decision on the City's application to pump water from the proposed Big Chino Water project:
1—rejected the appeals to the ADWR Draft Decision and Order issued November 12, 2008
2—affirmed the Draft Decision and Order, which determined that the City has the right to withdraw 8,067.4 acre-feet per year of groundwater from the Big Chino Sub-basin and transport it for uses within the service areas of Prescott and Prescott Valley
3—recommended that ADWR modify the Draft Decision and Order to grant importation of an additional 500 acre-feet per year to replace the YPIT's (Yavapai-Prescott Indian Tribe) CAP (Central Arizona Project)allocation (agreeing with Prescott that the quantity should be increased)
4—recommended that the Draft Decision and Order be affirmed by the Director of ADWR in all other respects (including awarding of 1,393 acre-feet of additional effluent for Assured Water Supply, which the City refers to as "Alternate Water", and which was not contested in the appeal).
