News Flash: November General Election to Proceed on Schedule

PRESCOTT, AZ (October 26, 2009) In the case of Paul Katan vs. The City of Prescott, the Arizona State Court of Appeals has reversed the judgment of the trial court and removed the injunction prohibiting the City from conducting its general election and the requirement to place Katan's name on the ballot.
After meeting in conference today, Judges John C. Gemmill, Jon W. Thompson, and Patrick Irvine concluded: "Katan is not entitled to be on the general election ballot. The official canvass of the primary election on September 8, 2009, found that he was not one of the primary election candidates entitled to be placed on the general election ballot."
"We're very pleased that the Court of Appeals interpreted the charter, case law, and statutes as the City did," said Liz Burke, City of Prescott Clerk. "The election will proceed on schedule and I encourage voters to keep their ballots and vote."
