News Update: Court of Appeals Decision Allows November General Election to Proceed

On Monday, October 19, 2009 the Arizona Court of Appeals stayed Yavapai County Superior Court Judge Michael Bluff's order which effectively prevented the November general election from proceeding. "This stay allows the election to proceed so voters can still vote with the ballots they received in the mail," said City Clerk, Elizabeth Burke.
Backstory: Council candidate Paul Katan finished in seventh place in the September primary ballot election. When fifth place finisher Bob Bell dropped out of the race, Katan contended that he should have been moved up to the sixth position and placed on the November general election ballot.
The city's legal department disagreed, arguing Prescott's city charter stipulates that only the top six finishers in the primary election are to be placed on the general election ballot.
In response, Katan's attorney filed a motion with the Yavapai County Superior Court seeking to have Katan's name placed on the ballot. Judge Bluff subsequently ruled in Katan's favor, effectively halting the election.
